1. Purpose
These Terms of Use govern access to and use of the MemoRide mobile application, website and API (the "Service"), published by [TO COMPLETE: publisher legal name].
MemoRide is a rider journal used to manage horses, training sessions, shows, class entries, health visits, reminders, checklists, media and community sharing.
2. Acceptance
Creating an account, accessing the Service or using the application implies acceptance of these Terms. If the user does not accept them, they must not create an account or use the Service.
3. Account and Eligibility
Registration is open to users aged at least 15 years old. Minors must obtain the required permission from their legal representatives when applicable. The publisher may request proof of age or authorization.
The user must provide accurate information, keep their login credentials confidential and promptly update their account details when they change. Any activity performed through the account is deemed to have been performed by the account holder unless proven otherwise.
4. Service Features
The Service currently includes, depending on the platform and the user's plan:
- horse profiles, including health, sessions, show history, public profile and sharing settings;
- training sessions with objectives, rating, rider, notes, positive points, areas for work and media;
- shows, classes, horse entries, results, rankings, times and entry media;
- health visits, next due dates, reminders and checklists;
- community profiles, invitations, blocked users, activity feed and search for accessible riders and horses;
- reporting tools and moderation actions for rider profiles, horse profiles, media and community posts;
- subscriptions, invoices, payment methods and storage management through Stripe.
Some features may be available first on the mobile application or on the website before being synchronized on the other platform.
5. Privacy and Sharing
The user can choose visibility settings for their profile and supported content: private, community or public. Public visibility may make a profile or horse profile discoverable in search. Community visibility is limited to accepted community members. Private content is not visible except where the user grants explicit access.
The user remains responsible for choosing the appropriate visibility, especially when publishing photos, videos, competition results or information relating to another person.
6. User Content
The user remains the owner of the content they upload or create. By using the Service, the user grants the publisher a non-exclusive, worldwide, royalty-free license limited to what is necessary to host, store, reproduce, display, transmit, resize, encode, secure and delete the content as part of operating the Service.
Uploaded photos may be cropped or resized and uploaded videos may be compressed or re-encoded to improve compatibility, storage use and display quality.
The user warrants that they hold the rights and authorizations required for the content they upload, including photos and videos of riders, horses, third parties or events.
7. Prohibited Use
The user must not:
- publish unlawful, abusive, defamatory, hateful, violent or privacy-infringing content;
- publish nudity, sexual content, shocking content or content unsuitable for the purpose of the Service;
- upload content for which they do not hold the required rights;
- attempt to bypass quotas, security, authentication or visibility rules;
- use the Service to harass another user or send unsolicited messages;
- interfere with the Service, its API, hosting, storage or payment systems.
8. Reports, Blocking and Moderation
Users can report rider profiles, horse profiles, media and community posts when they believe that content breaches these Terms, infringes rights or creates a safety issue. Reports may include one or more reasons such as illegal content, nudity or sexual content, violence or danger, harassment, spam, privacy infringement or another reason.
The publisher may hide, restrict, delete or restore content after review. Content reported for nudity or sexual content may be hidden immediately. Content receiving several reports, including the automatic threshold configured in the Service, may also be hidden pending review. If reports are found to be unfounded, the publisher may restore the content.
Users may block another user. Blocking removes the user from the blocker’s community where applicable and prevents the blocked user from adding the blocker again or accessing the blocker’s public rider and horse profiles while the block remains active.
Abuse of the reporting, blocking or invitation features may itself lead to moderation measures.
An account may be suspended when a temporary restriction is required while the publisher reviews a situation. Suspension blocks access to the Service but keeps account data and media. In the event of a ban, access remains blocked, the public rider profile, public horse profiles, search results and community visibility are disabled, and any active paid subscription may be scheduled for cancellation at the end of the already-paid period. Media linked to a banned account is retained for audit and evidence purposes unless the publisher decides to purge it from storage.
9. Free Plan, Premium and Pro
The Service offers a free plan and paid Premium and Pro subscriptions, billed monthly or yearly. The free plan keeps the core journal available but is limited to 5 horses. Training sessions and shows are not limited by count in the free plan.
Every plan may upload one rider profile photo and one main photo per horse, without counting those identity photos against the media storage quota. Premium and Pro unlock the other media uploads and higher usage limits, including up to 20 horses and the storage quota displayed in the application or website. Additional storage options may be offered to paid subscribers.
Current prices, storage quotas, renewal dates and any immediate amount due are displayed before the user confirms a subscription, plan switch or storage option.
10. Billing and Subscription Changes
Payments, cards, invoices and subscription operations are processed by Stripe. The publisher does not store full bank card numbers.
Subscriptions renew automatically unless cancelled before the renewal date. Cancellation takes effect at the end of the current paid period, unless otherwise required by law.
Switching from Premium to Pro is immediate and may generate a prorated amount calculated by Stripe. Switching from Pro to Premium is scheduled at the end of the current Pro period so the user keeps the already-paid Pro benefits until then. If the user's usage later exceeds the Premium limits, the Service may block new uploads or actions until the account is brought back within quota or upgraded.
Founder or launch discounts, when offered, apply only under the conditions displayed at checkout. Unless expressly stated otherwise, a founder discount applies to the first paid year only.
11. Downgrade to Free and Media Retention
When a paid subscription ends and the account returns to the free plan, only the first 5 horses are kept in the free plan. Horses above that limit may be deleted or made inaccessible according to the downgrade process shown before confirmation.
Photos and videos attached to the account may be retained for a grace period displayed in the Service before permanent deletion. The user should download or preserve any content they need before the end of that period.
12. Right of Withdrawal
Where applicable, consumers have a fourteen-day withdrawal period after subscribing. If the user requests immediate access to paid digital features, they acknowledge that the withdrawal right may be waived or reduced for the part of the Service already provided, according to applicable law.
13. Account Deletion
The user may request account deletion from the settings. Deletion removes the account and associated operational data, including horses, sessions, shows, class entries, health visits, reminders, checklists, notifications, shared accesses, posts and media, subject to legal retention obligations. Already issued invoices may be retained by Stripe and/or the publisher for accounting obligations.
14. Availability and Changes
The Service is provided with reasonable care but without a guarantee of uninterrupted availability. Maintenance, incidents, updates, third-party failures or force majeure may temporarily affect access.
The publisher may update, improve, suspend or remove features, especially for security, legal, technical or product reasons.
15. Intellectual Property
The MemoRide brand, logo, interface, design, texts, code and visual elements are protected by intellectual property law and remain the property of the publisher or its licensors. Unauthorized reproduction is prohibited.
16. Liability
MemoRide is a tracking and organization tool. It does not replace veterinary, medical, legal, financial, sports or professional advice. The user remains solely responsible for decisions made based on information entered in the Service.
17. Changes to the Terms
The publisher may update these Terms. Users will be informed before significant changes take effect when required. Continued use of the Service after the effective date means acceptance of the updated Terms.
